Federal Grand Jury Rejects Trump’s DOJ Case Against Letitia James — For the Third Time

Written by on 12/12/2025

A federal grand jury in Virginia has once again refused to indict New York Attorney General Letitia James, marking the third major setback for the Department of Justice in its increasingly shaky mortgage-fraud case.

According to The New York Times, this is the second time in one week that prosecutors failed to secure charges—an unmistakable sign that jurors aren’t buying the DOJ’s push to revive allegations that James misled a lender while purchasing her Norfolk, Virginia home.

The latest rejection came Thursday in Alexandria, where prosecutors alleged James improperly listed the three-bedroom property as her second residence, enabling her to secure favorable mortgage terms rather than the stricter rates tied to investment properties.

That argument didn’t land.

Again!!!!

Earlier in the week, a separate grand jury in Norfolk also declined to indict James on the same claim. That followed a judge’s decision last month to throw out the original indictment due to the prosecutor’s improper appointment—an embarrassing procedural failure that forced the DOJ to start from scratch.

James’s attorney, Abbe D. Lowell, didn’t hold back in his statement to the Times, saying the latest rejection confirms what should have been obvious from the start.

“This case already has been a stain on this department’s reputation and raises troubling questions about its integrity,” Lowell said. “Any further attempt to revive these discredited charges would be a mockery of our system of justice.”

James has consistently and categorically denied any wrongdoing. The DOJ now faces a hard truth: after three failed attempts, the case appears to have run out of road.
