Judge Tells Diddy: Explain Why You Deserve Civilian Clothes at Sentencing

Diddy will have to convince a federal judge why he should be allowed to wear civilian clothes instead of jail-issued attire when he appears for sentencing on October 3, 2025.
U.S. District Judge Arun Subramanian denied Diddy’s earlier request to dress in non-prison clothing at a September 25 hearing, saying his legal team failed to provide a valid reason. However, the judge left the door open for sentencing — if Diddy’s lawyers can give a stronger explanation.
So far, the defense has submitted a scaled-back request: two button-down shirts, two pairs of pants, two sweaters, and one pair of shoes without laces. That’s less than what he was allowed during his criminal trial earlier this year, when he was permitted more items to avoid prejudice before a jury.
The October hearing will decide Diddy’s fate after his conviction on two counts of transporting individuals across state lines for prostitution under the Mann Act. Prosecutors say he directed and sometimes participated in the acts, secretly recorded them, and met the legal definition of trafficking.
Diddy’s legal team is still fighting back, arguing prosecutors misapplied the law. They claim he never profited from prostitution, never transported anyone himself, and that paying escorts to perform with his partners was protected under the First Amendment.
Judge Subramanian has not yet ruled on their motion for acquittal or a new trial. Diddy has been in custody since September 2024, after bail was denied over concerns of violence and witness tampering.
Combs’ legal team had asked for him to be able to wear the sweaters he wore during the trial at Thursday’s appearance, but Judge Arun Subramanian did not sign off on the request in time.
He’s expected to be able to wear his own clothes at next week’s sentencing.
