Judge Orders Diddy to Hand Over “Freak-Off” Tapes to FBI Custody

Written by on 10/15/2025

A federal judge has officially ordered Sean “Diddy” Combs to surrender a cache of personal recordings and electronic devices tied to what prosecutors have described as his infamous “freak-off” sessions. The mandate, filed Wednesday, directs that all materials seized in 2024 federal raids be turned over to U.S. Customs and Border Protection and then transferred to FBI custody for secure preservation.

The court filing requires Combs to relinquish “the tapes, devices, and other recordings” classified as “property used or intended to be used” in connection with his prostitution-related convictions. Among the seized materials are cassette tapes, hard drives, thumb drives, iPhones, iPads, and computers.

Prosecutors allege these recordings — sometimes referred to as the “Ibiza tapes” — document sexual performances involving Combs, escorts, and other participants. Investigators claim the recordings are central evidence linked directly to the counts on which he was convicted.

Diddy’s Defense Pushes Back

Combs’ legal team argues the footage is constitutionally protected, insisting it captures “consensual adult activity” rather than criminal acts. “Far from the government’s lurid descriptions, the videos show adults having consensual sex, plain and simple,” his attorneys stated in a filing. They also dismissed rumors of secret cameras, tunnels, or coercion.

Despite those objections, the judge sided with prosecutors, ruling that preserving the evidence outweighs any defense claims of disclosure or personal privacy.

What Happens Next

The tapes will remain in FBI custody as Combs appeals his conviction and contests the forfeiture order. Legal experts note the recordings could play a critical role in any additional investigations or related prosecutions, but the defense may challenge the government’s control over them on constitutional grounds.

Combs was sentenced on October 3, 2025, to four years and two months in prison and fined $500,000 after being convicted on two counts of transporting individuals for prostitution. He was acquitted on more serious racketeering and sex trafficking charges.

The case continues to unfold, with both sides signaling a protracted legal battle over how much of this evidence may ultimately become public — and how far the government’s reach over Combs’ private recordings can legally extend.
